This includes New York residents, out-of-state visitors, and international tourists. You do not need a medical card, a New York ID, or any form of registration. Just your ID and your money. How much can you buy at one time? New York's Office of Cannabis Management (OCM) sets per-transaction purchase limits at licensed dispensaries: Up to 3 ounces of cannabis flower per transaction Up to 24 grams of cannabis concentrate per transaction Edibles and other products have equivalent limits calculated in THC milligrams How much can you legally possess? Adults 21+ can possess: Up to 3 ounces of cannabis flower in public Up to 24 grams of cannabis concentrate Cannabis kept at home can be stored in larger quantities (up to 5 pounds of flower) Can you grow cannabis at home? Yes. Adults 21+ can cultivate up to 6 cannabis plants per person (3 mature, 3 immature) at their residence, with a household cap of 12 plants. Plants must be kept out of public view and cannot be visible from public spaces. Where You Can Consume Cannabis in New York This is where most confusion exists — and where most unintentional violations happen. The short version: legal consumption is significantly more restricted than legal purchase. Where You CAN Consume Private residences. Your home is the most straightforward legal consumption space. Smoke, vape, or eat edibles in your home without issue. If you rent, check your lease — landlords can prohibit smoking (including cannabis) in their properties, and many do. Outdoor public spaces where cigarette smoking is permitted. This is the part of New York's cannabis law that surprises most people from other states. New York does allow cannabis consumption in many outdoor public spaces — specifically, anywhere that cigarette smoking is legally permitted. In practice, this means many sidewalks, streets, and outdoor spaces in Buffalo and across the state. However: Parks are more complicated. New York State parks prohibit cannabis consumption. City parks in Buffalo follow local ordinances that can differ from state rules. Delaware Park, Canalside, and other popular Buffalo parks — check current local ordinances before assuming it's permitted. Federal buildings, federal housing, national parks, airports (including Buffalo Niagara International), and any federally regulated property prohibit cannabis under federal law regardless of state legalization. This includes the UB South Campus if it receives federal funding — which it does. In most businesses. Restaurants, bars, retail stores — private property where the owner hasn't specifically authorized cannabis consumption. Don't assume a bar that doesn't have a no-smoking sign is fine for cannabis. In hotels and Airbnbs. Most prohibit smoking including cannabis. Check before you light up. Violations can result in significant fees or removal from the property. In workplaces. Employers can prohibit cannabis consumption during work hours and on work premises. Many do. Driving and Cannabis: The Most Important Section Do not drive under the influence of cannabis. This is both a moral imperative and a legal one. New York's DWI laws cover cannabis impairment. A police officer who suspects cannabis impairment can conduct a roadside assessment, and New York has trained Drug Recognition Experts (DREs) specifically to evaluate cannabis impairment. A conviction for driving while ability impaired by drugs (DWAI-Drugs) carries serious consequences: fines, license suspension, potential jail time, and a permanent record. Unlike alcohol, there is no universally agreed-upon threshold for cannabis "impairment" in blood or saliva testing — the science is still developing. But this doesn't mean you can drive high. It means officers rely on behavioral assessment, and if you're impaired, they can make that case. Practical rules for cannabis and driving in Buffalo: If you've consumed, do not drive until you are fully sober. If you're not sure whether you're sober enough, you're not. Student housing. Many off-campus rental properties near UB prohibit smoking in their leases, which typically includes cannabis. Know your lease before you light up in your apartment. Purchasing Cannabis as an Out-of-State Visitor in Buffalo Buffalo's proximity to Canada and its position as a destination for Canadians, Pennsylvanians, and other out-of-state visitors means this question comes up often. The same applies going the other direction. Do not take cannabis across the Peace Bridge into Canada. Do not drive with it across any state line.
